Job02Summary: The position provides strategic legal advice and support to the company’s operations in China. This role involves managing legal risks, ensuring compliance with Chinese laws and regulations, handling complex legal matters, and working closely with the local and global legal team.
Key Responsibilities: 1.Legal Advisory and Support: 80Provide expert legal advice to senior management on a wide range of legal issues related to the company’s operations in China. 80Advise on corporate governance, acquisitions, joint ventures, and other strategic business initiatives. 80Support the review of the marketing materials and product packages. 2.Compliance and Risk Management: 80Ensure the company’s compliance with Chinese laws and regulations, including corporate, employment, intellectual property, data protection laws, and direct selling regulations. 80Develop and implement compliance programs and policies to mitigate legal risks. 80Conduct regular audits and training sessions to educate employees on compliance matters. 3.Contract Management: 80Draft, review, and negotiate complex contracts and agreements with clients, vendors, partners, and other stakeholders. 80Develop template contract forms for use by business and support training and implementation of use of templates in the business. 80Ensure that all contracts align with the company’s legal and business objectives and minimize potential legal exposure. 4.Dispute Resolution and Litigation: 80Manage and resolve legal disputes, including negotiations, settlements, intellectual property infringement and litigation. 80Liaise with external counsel and represent the company in legal proceedings when necessary. 5.Intellectual Property: 80Manage trademark applications, renewal and oppositions including docketing with external agencies. 6.Data Privacy: Support the global data privacy officer in the development of policies relating to data security and privacy in China; and advise on legal aspects of best practices for data security and privacy and relating to transfer of data outside of China. 7.Regulatory Affairs: 80Monitor changes in Chinese laws and regulations that may impact the company’s operations. 80Advise on regulatory issues and work with government authorities to ensure compliance. 9.Team Development: 80Must be a team player to work with a team of legal professionals, providing guidance and support to ensure high performance. 80Foster a collaborative and proactive legal team environment. 10.Cross-Functional and HQ Collaboration: 80Work closely with HQ legal team and other local departments, marketing, finance, HR, and operations, to support the company’s business objectives. 80Provide legal insights during the development of business strategies and initiatives. 02 Qualifications: Education: Bachelors degree in Law (LLB) is required. A Masters degree (LLM) or equivalent qualification from a reputable university is preferred. Qualified to practice law in China (PRC bar qualification) is mandatory.
Experience: Minimum of 5 years of relevant legal experience, with at least 3 years in a senior legal role within a domestic or international DS//FMCG/retail company. Extensive knowledge of Chinese corporate, commercial, direct-selling, cross-border e-commerce and regulatory laws. Proven experience in managing complex legal matters, including direct selling, e-commerce, compliance, and litigation.
Skills: Strong leadership and people management skills. Excellent negotiation, drafting, and communication skills. Ability to work independently and make sound legal decisions. Fluent in Mandarin and English, both written and spoken. Personal Attributes: Strategic thinker with the ability to anticipate and manage legal risks.
