Serve as the legal counsel for an import/export trading company, ensuring compliance with PRC trade regulations (e.g., MOFCOM, SAFE, Customs, CIT), international trade laws, and corporate governance standards.
Key Responsibilities: 1. Legal & Regulatory Compliance: 2. Advise on compliance with PRC trade laws (e.g., Foreign Trade Law, Customs Regulations, Export Control Rules) and international frameworks (e.g., Incoterms). 3. Monitor and interpret evolving regulations impacting cross-border trade (e.g., SAFE forex controls, MOFCOM licensing, CIT/VAT rules). 4. Risk Mitigation & Transaction Support: 5. Review and negotiate trade agreements (supply, distribution, logistics), ensuring alignment with PRC and counterparty jurisdictions’ laws. 6. Identify and mitigate risks in high-value transactions, including loans and bank credits, customs disputes. 7. Dispute Resolution: 8. Manage trade-related disputes (e.g., cargo damage, contract breaches) and coordinate litigation/arbitration strategies. 9. Qualifications & Skills 10. Education: LLB/LLM from a recognized Chinese university; PRC Bar qualification preferable. 11. Experience: 5+ years in international trade law, preferably within a Chinese trading company, law firm, or multinational corporation. 12. Technical Expertise: 13. Deep knowledge of PRC Customs, SAFE, and MOFCOM regulations, PKULAW software. 14. Familiarity with Incoterms, cross-border contracts, and trade finance instruments.
Language: Native Mandarin; business-level English for drafting international agreements.
