Key Responsibilities: 1. IP Portfolio Management:02Oversee the company’s IP portfolio, including patents, trademarks, and copyrights. Conduct regular audits to ensure all IP assets are properly protected and maintained.
2. Patent Strategy:02Develop and implement patent strategies for new products, technologies, and innovations in the vaping industry. Draft, file, and prosecute patent applications in collaboration with external counsel.
3. Trademark Protection:02Manage the registration, enforcement, and defense of trademarks, including brand names, logos, and product designs. Monitor for potential infringements and take appropriate legal action.
4. Trade Secret Protection:02Advise on the protection of trade secrets and confidential information, including drafting and enforcing non-disclosure agreements (NDAs) and confidentiality policies.
5. Litigation Support:02Represent the company in IP-related disputes, including patent infringement, trademark opposition, and trade secret misappropriation cases. Collaborate with external counsel as needed.
6. Regulatory Compliance:02Stay informed about industry-specific regulations and ensure the company’s IP practices comply with local, national, and international laws.
7. Contract Drafting and Review:02Draft, review, and negotiate IP-related agreements, including licensing agreements, manufacturing contracts, and distribution agreements.
8. Competitive Analysis:02Monitor competitors’ IP activities and provide strategic advice to mitigate risks and capitalize on opportunities.
9. Client Advisory:02Work closely with internal teams, including R&D, marketing, and product development, to provide proactive legal guidance on IP matters. Education and Training:02Educate employees on IP best practices and the importance of protecting the company’s intellectual property.
Qualifications: 1. Education:02Juris Doctor (JD) degree from an accredited law school. 2. Licensure:02Admission to the state bar and in good standing. Admission to the USPTO (United States Patent and Trademark Office) is highly preferred. 3. Experience:02Minimum of 5 years of experience practicing intellectual property law, with a focus on patents and trademarks. Experience in the vaping, tobacco, ***, or consumer electronics industries is a strong plus.
